These Terms and Conditions govern your use of the Classic Jewellers website and any purchases made through our online store.

 

By accessing or using this website, placing an order, or purchasing any product from Classic Jewellers, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

 

These Terms and Conditions are governed by the laws of the Republic of South Africa, including applicable provisions of the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

 

Nothing in these Terms and Conditions is intended to limit, exclude or waive any consumer right that cannot lawfully be limited, excluded or waived.

 

1. ABOUT CLASSIC JEWELLERS

 

Classic Jewellers is a jewellery retailer and manufacturing jeweller based in South Africa.

 

We sell jewellery, watches and related products through our physical store and online store. Certain items may be manufactured, customised, resized, repaired or specially ordered according to a customer's requirements.

 

2. WEBSITE USE

 

You may use this website for lawful purposes only.

 

You agree not to:

 

* Use the website for fraudulent, unlawful or unauthorised purposes;

* Attempt to gain unauthorised access to the website or its systems;

* Interfere with the security or operation of the website;

* Copy, reproduce, modify or commercially exploit website content without our written permission;

* Use images, descriptions, logos, designs or other intellectual property belonging to Classic Jewellers without permission.

 

Classic Jewellers reserves the right to restrict or terminate access to the website where reasonably necessary, subject to applicable law.

We make reasonable efforts to ensure that product descriptions, photographs, prices, specifications and other information displayed on the website are accurate and up to date.

* Natural gemstones may vary in colour, clarity, inclusions and appearance;

* Handmade and manufactured items may have minor variations;

* Product measurements and weights may have reasonable manufacturing tolerances;

* Product images are provided for illustrative purposes unless specifically stated otherwise.

 

Where a product contains a natural gemstone, diamonds or other natural materials, variations in appearance are part of the natural characteristics of the material.

 

If a product is materially different from its description or does not meet the standards required by applicable law, your statutory consumer rights remain unaffected.

 

4. PRICES

 

All prices displayed on the website are in South African Rand (ZAR) unless otherwise stated.

 

Prices displayed include VAT where applicable.

 

Classic Jewellers reserves the right to correct pricing errors or inaccuracies. If an incorrect price is displayed and an order has been placed, we will contact you before processing the order where appropriate.

 

We reserve the right to change prices at any time. Any price change will not affect an order that has already been accepted and paid for, except where permitted by law.

 

5. PRODUCT AVAILABILITY

 

All products are subject to availability.

 

Where an item becomes unavailable after an order has been placed, Classic Jewellers will contact the customer and may offer:

 

* A suitable alternative;

* A revised estimated delivery date; or

* A refund where applicable.

 

If we are unable to fulfil an order, any amount paid for the unavailable product will be refunded in accordance with applicable law.

 

6. ONLINE ORDERS

 

When you place an order through our website, you are making an offer to purchase the selected products.

 

Your order is only considered accepted by Classic Jewellers once payment has been successfully received and we have confirmed acceptance of the order.

 

An automated order acknowledgement does not necessarily constitute final acceptance of the order.

 

Classic Jewellers reserves the right to refuse or cancel an order where reasonably justified, including where:

 

* A product is unavailable;

* There is an obvious pricing or description error;

* Payment has not been successfully authorised;

* Fraudulent or suspicious activity is suspected;

* The requested delivery information is incomplete or incorrect; or

* Circumstances beyond our reasonable control prevent fulfilment.

 

Where an order is cancelled by Classic Jewellers after payment has been received, the applicable amount paid will be refunded.

 

7. PAYMENT

 

Payment must be made using the payment methods made available on our website.

 

Orders will only be processed once payment has been successfully received or authorised.

 

Classic Jewellers does not store complete credit or debit card details where payment is processed through a third-party payment provider.

 

You are responsible for providing accurate billing and payment information.

 

8. FRAUD PREVENTION

 

Classic Jewellers reserves the right to verify orders and payment information where reasonably necessary to protect customers and the business against fraud.

 

We may request additional information or verification before dispatching a high-value order.

 

Where an order cannot reasonably be verified, Classic Jewellers may cancel the order and refund the amount paid, subject to applicable law.

 

9. DELIVERY

 

Orders will be delivered using the delivery method selected or made available at checkout.

 

Delivery timeframes provided on the website are estimates and may be affected by:

 

* Courier delays;

* Public holidays;

* Weather conditions;

* Incorrect or incomplete delivery information;

* Unforeseen operational circumstances; or

* Other circumstances beyond our reasonable control.

 

The customer is responsible for ensuring that the delivery address and contact details supplied at checkout are correct.

 

Additional delivery charges may apply where a parcel needs to be redirected due to incorrect information supplied by the customer.

 

Risk in the goods will pass to the consumer in accordance with applicable South African law.

10. INSPECTION OF GOODS

 

Customers should inspect their jewellery or other products as soon as reasonably possible after delivery.

 

If you believe that an item is damaged, defective, incorrect or materially different from what was ordered, please contact Classic Jewellers as soon as possible with your order number and photographs where appropriate.

 

This does not affect any statutory rights available to you under the CPA.

 

11. RETURNS, REFUNDS AND EXCHANGES

 

Classic Jewellers has a separate *Returns and Refund Policy*, which forms part of these Terms and Conditions.

 

Subject to the applicable law and our Returns and Refund Policy:

 

* Unwanted items may be returned within the applicable return period if they remain in their original condition and packaging;

* Exchanges or store credit may be available within the applicable exchange period;

* Items must be returned with their original packaging, documentation and accessories where applicable;

* Items that have been worn, damaged, altered, engraved, resized or customised may be subject to different return conditions.

 

Nothing in our Returns and Refund Policy limits any rights that a consumer may have in respect of defective, unsafe or unsuitable goods under the CPA.

 

12. CUSTOM, BESPOKE AND SPECIAL-ORDER JEWELLERY

 

Certain jewellery may be specially manufactured, customised or ordered according to the customer's specifications.

 

This may include:

 

* Custom-designed jewellery;

* Bespoke jewellery;

* Engraving;

* Ring resizing;

* Special gemstone or diamond selections;

* Alterations;

* Personalised items; and

* Special-order products.

 

Because these products are made or ordered specifically for the customer, they may not be eligible for return due to a change of mind, subject always to the customer's statutory rights under applicable law.

 

Customers should carefully confirm all specifications, including ring size, engraving details, gemstone preferences and personalisation, before confirming a customised order.

 

Where Classic Jewellers makes an error in fulfilling a confirmed specification, we will assess the matter and provide an appropriate remedy in accordance with applicable law.

 

13. RING SIZING

 

Customers are responsible for selecting the correct ring size when ordering online.

 

We strongly recommend having your finger professionally measured before placing an order.

 

If a ring needs resizing after purchase, additional charges may apply depending on the design, metal, gemstones and amount of work required.

 

Certain designs may not be suitable for resizing or may have limitations on the amount by which they can be resized.

 

14. JEWELLERY CARE

 

Jewellery requires appropriate care and maintenance.

 

Classic Jewellers is not responsible for damage caused by misuse, accidental damage, normal wear and tear, improper storage, exposure to chemicals, harsh cleaning products, excessive force or failure to follow appropriate jewellery-care instructions.

 

Jewellery containing gemstones should be handled carefully, as stones may become damaged or loosened through impact or wear.

 

Where appropriate, customers should have gemstone settings and claws professionally inspected periodically.

 

15. DIAMONDS AND GEMSTONES

 

Natural diamonds and gemstones may contain natural inclusions and variations.

 

Where applicable, certification details will be provided in the product description or supplied with the product.

 

Diamond and gemstone characteristics may differ between individual stones even where the stones have similar specifications.

 

Where a customer specifically selects a gemstone or diamond, the characteristics of the selected stone will apply to that particular item.

 

16. GOLD AND PRECIOUS METALS

 

Gold jewellery may be manufactured in different purities, including but not limited to 9ct, 18ct and other legally recognised standards.

 

Precious metal colour and appearance may vary depending on the metal composition, finish and lighting.

 

Natural wear, scratching, polishing and changes in surface appearance are normal characteristics of jewellery ownership and do not necessarily constitute a manufacturing defect.

 

17. WATCHES

 

Watch warranties, where applicable, are subject to the manufacturer's warranty terms.

 

Unless specifically stated otherwise, Classic Jewellers does not warrant that a watch is suitable for exposure to water beyond the manufacturer's stated water-resistance rating.

 

Water resistance may deteriorate over time and should be checked and maintained as recommended by the manufacturer.

 

18. PROMOTIONS AND DISCOUNTS

 

Promotions, discounts and special offers are subject to their individual terms.

 

Unless otherwise stated:

 

* Promotions cannot be exchanged for cash;

* Promotional offers cannot necessarily be combined;

* Discount codes must be entered at checkout where required;

* Promotional items are subject to availability.

 

Classic Jewellers reserves the right to withdraw or amend a promotional offer where reasonably necessary, subject to applicable law and any rights already acquired by customers.

 

19. GIFT CARDS AND VOUCHERS

 

Where Classic Jewellers offers gift cards or vouchers, the specific terms applicable to the relevant gift card or voucher will apply.

 

Gift cards and vouchers may not be exchanged for cash unless required by law.

 

Lost or stolen gift cards should be reported to Classic Jewellers as soon as possible.

Classic Jewellers will not be responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, fires, floods, strikes, civil unrest, power failures, internet or telecommunications failures, courier disruptions, government restrictions or other unforeseen events.

 

Where reasonably possible, we will notify affected customers and take reasonable steps to minimise the impact.

 

27. CHANGES TO THESE TERMS AND CONDITIONS

 

Classic Jewellers may update these Terms and Conditions from time to time.

 

The latest version will be published on this website with the applicable effective date.

 

Changes will not retrospectively remove rights that have already accrued to consumers.

These Terms and Conditions are governed by the laws of the Republic of South Africa.
